The case of Ousseinou Diop: the reluctance and desire that France will not be used
In four (4) years, young Senegalas under the name Ousseinou Diop remain in the prison of Rebeuss. He is prosecuted for apologizing for terrorism, after commenting on his Facebook page after the attack by Charlie Hebdo. At the material time, he was only 19 years old and was a second-year student at the University of Sheikh Anta Diop University in Dakar (UCAD) at the Faculty of Science and Mathematics. It's not settled yet. He remains in prison for four years under the pre-trial detention system.
According to DakarActu (site near power), Ousseinou Diop posted on his Facebook page, nicknamed "Hussein Veuz", founded in New York, the next message, 3 days after Charlie Hebdo attack in January 2015: "I am happy with his attacks, because you will not have to forget what you did with the work of Charlie Hebdo who caricatured the face of our dear Prophet Mohammed (Psl) and pay the price. The happiness of our dear Muslim brother Koulibalia (ed., Jihadist who was killed in the attack on Hiper Carcher.) And I'm telling you, and suggesting that the second attack will be during the Nice-Lyon match. " It was followed by the French authorities, who immediately warned their Senegalese colleagues who arrested him.
In view of such remarks, Ousseinou Diop allegedly committed the criminal offense of Apology for Terrorism, understood as describing, presenting or commenting on a criminal offense by calling for a favorable moral judgment against him. He could also be considered the author of a false terrorist warning. Given his age and circumstances, is his continued detention for four years justified up to now? The answer is, unequivocally, NO! Indeed, for similar facts, the young French had the sanction they deserved and were proportionate to the mistake made. Two examples relating to Charlie Hebdo's attacks can illustrate our point and at the same time demonstrate the integrity and sense of the measure of French justice. The first refers to a 19-year-old French boy who on social networks greeted the atrocities committed by the attacks. This young person was tried and convicted by the Criminal Court of Carpentras "Apology for a terrorist act", a suspended sentence of 12 months and 210 hours of service in the community (https: //vvv.laprovence.com/actu/faits-divers-en-direct/3212237/un-liceen-condamne-pour-apologie-des-attentats.html). You read well 12 months of parole and community service! Another example relates to another twenty-five year old who, when writing on Facebook, was thrilled that the Charlie Hebdo attack was a "Day of the Holiday", in addition to joking about the assassination of policeman Ahmed. Finally, in France, the author of a false warning of taking hostages on Saturday, September 17, 2016 in the center of Paris (in the church), which caused the mobilization of helicopters, police, gendarmes and soldiers, would be sentenced only between six months and two years in prison, and between 7,500 and 7,000 euroshttps: //vv.lemonde.fr/les-decodeurs/article/2016/09/19/kue-riskuent-les-auteurs-d-une-fausse-alerte-terroriste_4999873_4355770.html). What is astonishing is the duration and form of these sentences. Miles are 4 years of pre-trial detention, which Ousseinou Diop continues to support. While she was firm, French justice could have given a second chance to these young people who would no doubt think more than once before hitting social networks to apologize for terrorism. The second lesson to be remembered did not show French justice, nor as a machine to break young people, to break the hopes of the entire family. On the contrary, she knew how to do pedagogical work, taking into account, certainly, the accused, given that partly mistakes were made by people only from adolescence such as Ousseinou Diop. If our authorities, both administrative and judicial, want to stay in France, have at least some intelligence to do so by copying positive aspects. Under the altar of endurance and the enchanting desire to pay off their masters, they have practically ended up destroying the lives of a young person and destroying the family's hopes. This is unacceptable and should lead us to mobilization to request the immediate release of Ousseinou Diop, as soon as possible, as soon as possible.
The Thiantacounes affair: proof of the double speed of justice
As a reminder, in 2015, two compatriots, Bar Sau and Abbacar Diagne, were brutally killed and buried in Medinatoul Salam, owned by Bethio Thioune. The investigation led to Bethio Thioune, the main killer sponsor and nine (9) other "Thiantacounes" who are considered contractors of this low-profile job. These are the Samba drop, Mamadou Anne, Mamadou Gueie, Demba Kebe, Moussa Diy, Khadim Seck, Mouhamed Sene, Ali Diouf and Cheikh Faie. Everyone was subjected to an arrest warrant, including Bethio Thioune before the other received a very quick, provisional release. 9 "Thiantacounes" continues, for 6 years, to torture in custody for detention This "Criminal conspiracy, concealment of hunt, unauthorized burial, non-publication of crimes and murders and acts of barbarism". Their application for provisional release was rejected by the Judge of the High Court of the Mbour Criminal Division on the grounds that they did not provide serious guarantees for representation, so that they could leave for a while. Six (6) years of detention for these Senegalese lambds in anticipation of the verdict! Even the president of the Senegalese Federal Judge acknowledges that it is not normal to keep a person in detention bonds for six years without trial. Even worse, the one who is considered the main sponsor of two murders continues to fight, to be surrounded by his wives and to organize huge "theaters" as if he was freed of any embarrassment while involved in cases of blood crime. The Assane Diouf case should be placed under this registry. He is held in prison, without trial, voluntarily for revenge. What is very serious (abuse of justice and power) and undermines the foundations of the rule of law!
The lack of interest of people: the loss of all indignation
What is shocking in these two (2) cases is the indifference of Senegal and Senegal. Inadmissibility can not exceed the punishments the defendant has in the two cases, while they have the right to be judged within a reasonable time, regardless of the fact that they are preamble. So far, only human rights organizations have accelerated to deny such a situation, but without success, because people do not. Students who had to ensure the beginning of a new academic year on the judgment of their colleague Ousseinou Diop are more illustrative in food requirements (scholarship payments, restaurant opening, room allocation, etc.). They give all the reasons for the desperation of our youth: without or little commitment to noble causes, for projects of society, or for building the future of the nation. As for our women and politicians, with the exception of the minority, most put their daily actions and concerns in the dynamics of seeking the situation of unjust wealth for personal well-being and for their family. What about academics? Those who are supposed to enlighten people are hiding in a mutilation, even a complacency with devastating effects on their necessary contribution to the creation of an informed and responsible public opinion. Academics have left the field of reflection and the commitment of haste, mainly in the voids "Xar Maat" trying not to disturb the supporters of the current power in the hope that it will benefit, but it is proclaimed. Marabouts? I do not think it exists anymore in Senegal because the last went (Mame Abdou Aziz Si Dabakh, Serigne Fallou, Serigne Saliou, Thierno Mouhamadou Saidou Ba etc.). So there is no need to count on them or to those who proclaim themselves!
The most serious thing is that the Senegalese people have come to a point where they are no longer bitter. He became a follower of indifference. We kidnap billions, he says that nothing foresees that we leave him a few crumbs. It deprives honest citizens of freedom under false pretenses, it does not matter, because it is a divine will. The President of the Republic redirects the appointing authority assigned to him by the appointment of members of his family, his clan, in addition to dishonest and incompetent people, consider it to be a lucky thing (a popular singer from Senegal says even that happiness is more than the license!). Indignation is important because it is a healthy reaction that, according to Stephane Hessel, leads to dedication. Without commitment, nothing will change in our current conditions! It's time to open our eyes and mobilize for justice to be done and says in the business Ousseinou Diop, "Thiantacounes" and Assane Diouf. None of us is sure of these injustices. They can always happen to us or fall on someone close to us. Therefore, we have an interest in surpassing and mobilizing so that the distribution of justice is fair and timely. The distribution of justice should not be done in relation to social status and / or financial or political power. Nor is it unacceptable to redirect the powers that people entrust to you in order to solve your personal accounts. Is not this the first sign of incompetence?
